广东省检察机关起诉破坏社会主义市场经济秩序犯罪19742件37383人

The21stSessionoftheStandingCommitteeofthe14thPeople’sCongressofGuangdongProvincewasrecentlyconvenedinGuangzhou.Atthemeeting,theheadsoftheprovincialpeople’scourtandtheprovincialpeople’sprocuratoratedeliveredreportsontheirworkrelatedtoservingandsafeguardingthedevelopmentofalaw-basedbusinessenvironment.Asisreported,from2023toAugust2025,procuratorialauthoritiesacrosstheprovinceprosecuted19,742casesinvolving37,383individualsforthecrimesthatdisruptedtheorderofthesocialistmarketeconomy.Theyexercisedequalaccountability,equalcharges,andequalpenaltiesforactsinfringinguponthepropertyrightsandlegitimateinterestsofentitiesunderallformsofownership.Specifically,theyprosecuted3,815trademark-relatedcrimesinvolving6,770individuals,aswellas148casesinvolving304individualsforcrimessuchaspatentcounterfeiting,copyrightinfringement,sellinginfringingreproductions,andtradesecretinfringement.

近日，广东省十四届人大常委会第二十一次会议在广州召开。省法院、省检察院负责人分别在会上做关于服务保障法治化营商环境建设工作情况的报告。报告显示，2023年至2025年8月，全省检察机关起诉破坏社会主义市场经济秩序犯罪19742件37383人，对侵犯各种所有制经济产权和合法利益的行为实行同责同罪同罚。起诉涉商标类犯罪3815件6770人，起诉假冒专利、侵犯著作权、销售侵权复制品、侵犯商业秘密等犯罪148件304人。

Theprocuratorialorgansacrosstheprovincealsoenhancedsupervisionoverlitigationactivitiesrelatedtoenterprises,effectivelystandardizinglawenforcementandjudicialpractices.Theydevelopedthenecessityreviewofdetentionincriminalcasesinvolvingbusinessmanagersandkeypersonnel,andstrengthenedcross-regionalsupervisorycooperationregardingcommunitycorrectionofrelevantindividuals,soastofacilitatetheresumptionofnormalproductionandoperationsforenterprises.

全省检察机关加强涉企诉讼活动监督，有力规范执法司法行为。包括对涉及企业经营管理者和关键岗位工作人员刑事案件，加强羁押必要性审查，针对相关社区矫正对象跨区域监管强化监督协作，便于企业恢复正常生产经营。
