Where the amount of liquidated damages agreed upon is lower than the losses incurred, the people's court or arbitration institution may, at the request of a party, increase the amount of liquidated damages; where the amount of liquidated damages agreed upon are significantly higher than the losses incurred, the people's court or arbitration institution may appropriately reduce it at the request of a party. 约定的违约金低于造成的损失的，人民法院或者仲裁机构可以根据当事人的请求予以增加；约定的违约金过分高于造成的损失的，人民法院或者仲裁机构可以根据当事人的请求予以适当减少。 Where the parties agree upon liquidated damages in respect to the delay in performance, the party in breach shall still perform the obligations after paying the liquidated damages. 当事人就迟延履行约定违约金的，违约方支付违约金后，还应当履行债务。
