Where the acceptance does not substantially modifies the contents of the offer, it shall be effective, and the contents of the contract shall be subject to those of the acceptance, except as rejected in a timely manner by the offeror or indicated in the offer that an acceptance may not modify the offer at all.

承诺对要约的内容作出非实质性变更的，除要约人及时表示反对或者要约表明承诺不得对要约的内容作出任何变更外，该承诺有效，合同的内容以承诺的内容为准。

In the case of contracting in the form of a data message,the place of formation of the contract shall be the main business place of the recipient, or absent a main business place, the place of its domicile, unless the parties agree otherwise.

采用数据电文形式订立合同的，收件人的主营业地为合同成立的地点；没有主营业地的，其住所地合同成立的地点。当事人另有约定的，按照其约定。
