The parties to civil legal relations shall perform their civil obligations and assume civil liabilities in accordance with the provisions of laws or the agreements of the parties. ⺠事主体依照法律规定或者按照当事人约定，履行民事义务，承担民事责任。 Where two or more persons share liability in accordance with the law, they shall assume corresponding liability respectively if their respective liabilities can be determined; or evenly assume liability if it is difficult to determine their respective liabilities. ⼆人以上依法承担按份责任，能够确定责任⼤小的，各自承担相应的责任；难以确定责任⼤小的，平均承担责任。 Where the non-performance of civil obligations is caused by a force majeure, no civil liability shall arise therefrom, except as otherwise provided for by any law. A force majeure means any objective circumstance that is unforeseeable, inevitable, and insurmountable. 因不可抗⼒不能履行⺠事义务的，不承担⺠事责任。法律另有规定的，依照其规定。 不可抗⼒是不能预见、不能避免且不能克服的客观情况。
